Disciplinary proceedings inside the Bar
Members of qualification commissions of Russian regional bar associations discussed the issues of ethics and standards of advocate’s activity
Among participants of the event were executive vice-president of the Federal Chamber of Lawyers Andrey Suchkov, vice-president of the Federal Chamber of Lawyers Svetlana Volodina, deputy chairman of the Ethics and Standards Commission of the Federal Chamber of Lawyers, president of the Bar Association of the Udmurt Republic Dmitry Talantov, deputy chairman of the Qualification Commission of the Moscow Bar Association, member of the Ethics and Standards Commission of the Federal Chamber of Lawyers Nikolay Kipnis, as well as over 60 representatives of bar associations from all over Russia, from Kaliningrad to Chukotka.
In his welcome speech Andrey Suchkov underlined that holding a round table dedicated to disciplinary proceedings in the Bar together with representatives of regional bar associations is extremely important for the Russian Federal Chamber of Lawyers. “Up to this moment regional disciplinary practice has been developing very actively and efficiently, but we have not always seen its unity. Disciplinary practices of different bar associations demonstrate different approaches to the same issues. Currently we are at the stage of unification of this practice, elaborating consistent approaches, so that our internal management does not change substantially depending on the region” - executive vice-president of the Federal Chamber of Lawyers stated.
Dmitry Talantov began the working section of the event with explaining the main area of activity and tasks of the Ethics and Standards Commission of the Russian Federal Chamber of Lawyers, specifically mentioning that the Commission was established due to the necessity to elaborate standards for the advocate’s profession and unified approaches to application of the Advocate’s Code of Professional Conduct, which is especially important in connection with the planned reform of the field of professional legal assistance and the idea under discussion to introduce monopoly of advocates for representation in court.
П. Besides, he told the participants about the Commission’s activity on clarifying the issues of application of part 1 art.17, part 3.1 of art. 9 and part 3 of art. 21 of the Advocate’s Code of Professional Conduct.
Dmitry Talantov also informed the participants of the course of work on elaborating a standard for participation of a defence advocate in criminal proceedings - earlier, the draft had been sent to regional bar associations for discussion: “At the moment we have received suggestions of amendments from 20 bar associations and from about 10 advocates” - Dmitry Talantov mentioned.

On April 27th, representatives of regional bar associations will attend a session of the Qualification Commission of the Moscow Bar Association, during which a qualification exam for the status of an advocate and examination of disciplinary proceedings will take place. On April 28th, a discussion of the qualification exam and disciplinary practice of the Moscow Bar Association, as well as closing the round table, are to be held in the Russian Federal Chamber of Lawyers. President of the Federal Chamber of Lawyers Yury Plilpenko and members of the Ethics and Standards Commission will take part in the discussion.
